Terms of Service

These Terms of Service ("Terms") govern your use of the isVerified service ("Service") provided by isVerified, Ltd. ("isVerified," "we," or "us"). By accessing or using the Service, you ("User") acknowledge and agree to be bound by these Terms.1
1. Relationship to Customer Agreement: You are accessing the Service as a member, employee, or contractor of an organization ("Customer") that has entered into a commercial agreement with isVerified, Ltd. Your use of the Service is subject to, and must comply with, the terms and conditions of that agreement. If your Customer organization ceases to have a valid agreement with isVerified, your access to the Service will be revoked.
2. Onboarding Requirement: Use of the Service is strictly limited to Users who have successfully completed the entire onboarding process as defined by isVerified. This may include identity verification steps, device registration, security clearance by your organization's designated administrator, and other protocols to ensure proper setup and secure usage.
3. Data Privacy and Sharing: isVerified does not and will not share any biometric data or personally identifiable information (PII) with any third party at any time.isVerified will share limited PII with the Customer's designated security administrator solely for the purposes of approving or managing your onboarding and access to the Service.
4. Account Suspension or Termination: isVerified reserves the right to pause, restrict, or terminate your access to the Service at its sole discretion, including but not limited to cases involving:
- Security concerns or violations;
- Failure to complete onboarding;
- Non-compliance with these Terms;
- Breaches by the Customer of their commercial agreement;
- Non-payment or billing issues.
5. Acceptable Use: You agree not to use the Service to engage in, promote, or support any unlawful, unauthorized, or malicious activity. This includes, but is not limited to:
- Impersonation of any individual or entity;
- Tampering with Service functionality or data;
- Violation of applicable laws or regulations.
6. Minimum Age Requirement: You must be at least 18 years old to use the Service.
7. Account Security: You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account. You agree to promptly notify isVerified of any unauthorized use or security breach related to your account.
8. User Content Ownership: You retain ownership of any data or content you submit through the Service. By submitting data, you grant isVerified a non-exclusive, limited license to use such data solely as necessary to provide and support and product improvements to the Service.
9. Software Updates: You agree that isVerified may automatically install software updates, which may include new features or functionality, as well as security patches, and that your continued use of the Service constitutes consent to such updates.
10. Limitation of Liability: To the maximum extent permitted by applicable law, isVerified shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, resulting from:
- Your access to or use of, or inability to access or use, the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service;
- Unauthorized access, use, or alteration of your transmissions or content.
Furthermore, isVerified is not liable for any harm arising from zero-day vulnerabilities or other security flaws inherent to the user's device, operating system, or third-party applications used to access the Service.
11. Modifications: isVerified reserves the right to update or modify these Terms at any time. Any changes will be communicated through the Service or via email. Continued use of the Service after such updates constitutes your acceptance of the revised Terms.
12. Governing Law: These Terms shall be governed by and construed in accordance with the laws of New York, without regard to its conflict of law provisions.
